German Securities Litigation - Class action

Shareholders of German registered companies like the Wirecard AG have several possibilities to recover their investment losses. Under German Securities Law claimants can file individual lawsuits at the Intermediate court. Recently the German legislature has given claimants the option to file a class action against the stock company (Kapitalanlegermusterverfahren). In this procedure the claims of all shareholders are consilidated in one procedure. This class action has the advantage, that only a fraction of legal fees are incurred. This leads to a very limited risk of litigation for the individual shareholder.

The consultation of institutional investors in regard to their investments deserves special attention. The analysis of the legal structure and the financial statements of incorporated companies provide a fundamental contribution to a successful implementation of investment strategies in the German market.
